1. An employee beats up a customer the employee claims was trying to shoplift. The customer sues the employee and loses. The customer then sues the employer on the theory of respondeat superior. Even when there was a mutuality requirement for collateral estoppel, this was a situation where the employer was allowed to use issue preclusion, despite the fact that he was not a party to the first suit.
