Study Questions on Hart Ch. VI

1) Hart draws a distinction between ultimacy and supremacy in connection with rules (on p. 105-06internal matters and Blue Red). What is the difference?

2) In what sense is the efficacy of the legal system presupposed by someone making an internal statement of law (see pp. 102-03)?

3) What are the necessary and sufficient conditions for the existence of a legal system, according to Hart (see pp. 116-17)? Is this enough to distinguish a legal system from, say, an organized group like the Boy Scouts?

4) From the bottom of p. 118 to the top of p. 120, Hart speaks of an apparent paradox that results from the interruption of a legal system. What is the apparent paradox and why does Hart think it is not a problem? Is he right?
